Dicamba products update for Minnesota farmers

Dicamba products; So can Minnesota farmers use it or not? That Ninth Circuit Court Ruling last week left a lot of producers in limbo. Here’s the latest update from the Minnesota Department of Agriculture.

Upon further review of state law and while awaiting guidance from the U.S. Environmental Protection Agency on the ruling of the 9th U.S. Circuit Court of Appeals regarding dicamba products, the Minnesota Department of Agriculture will continue operating under existing pesticide program authorities. According to Minnesota law, an unregistered pesticide previously registered in the state may be used following the cancellation of the registration of the pesticide.

At this time Minnesota farmers can use XtendiMax with VaporGrip Technology (EPA Reg. No. 524-617), Engenia Herbicide (EPA Reg. No. 7969-345), and DuPont FeXapan with VaporGrip Technology (EPA Reg. No. 352-913) while following all federal and Minnesota label requirements. (Tavium Plus VaporGrip Technology (EPA Reg. No. 100-1623) was not part of the two-year federal registration and can still be used according to the label). The Department does not anticipate taking enforcement action against those who continue to appropriately use these products. This may change at any time pending additional guidance from U.S. Environmental Protection Agency.

“The Circuit Court of Appeals decision to revoke the use of these products was, unfortunately, very untimely for our farmers as many had already purchased the herbicide for this growing season,” said Minnesota Agriculture Commissioner Thom Petersen. “Timing is critical for farmers to apply the products and our further interpretation of Minnesota law allows us to use these products.”

As a reminder, all dicamba pesticide applicators in Minnesota must follow use instructions on the product label including the timing restrictions below. Dicamba products cannot be applied to dicamba-tolerant (DT) soybeans in Minnesota if any of the following conditions has occurred. Whichever cutoff time occurs first will determine whether a person can apply a given product to DT soybeans until June 20, 2020.

  • Forty-five (45) days after planting. The federal labels for XtendiMax, Engenia, FeXapan, and Tavium prohibit application more than 45 days after planting.
  • Once the R1 growth stage begins (beginning bloom). The federal labels for XtendiMax, Engenia, and FeXapan prohibit this. The R1 stage is when at least 1 flower appears on the plant on any node on the main stem.
  • After the V4 growth stage. The federal label for Tavium prohibits application after the V4 growth stage.
  • After June 20, 2020. The Minnesota Special Local Need (SLN) label, which must be in possession of the applicator at the time of application, prohibits this for all four dicamba products.  The SLN labels are available on the MDA website at mda.state.mn.us/24c

In Minnesota, all four dicamba products are “Restricted Use Pesticides” for retail sale to, and for use only by, certified applicators who have complete dicamba or auxin-specific training.

Weed of the Month: Tree of Heaven?

Tree of heaven (Ailanthus altissima) is a deciduous tree native to China, Taiwan, and Vietnam. It was brought to the U.S. in the late 1700s as an ornamental shade tree. Today this tree is found in most of the Continental U.S., Hawaii, and Canada. It looks similar to staghorn sumacash, and walnut and has a strong, offensive odor that some describe as being similar to rotting peanuts. In 2020, the Minnesota Department of Agriculture changed the regulated noxious weed designation of tree of heaven from Restricted to Prohibited Eradicate, meaning that all tree of heaven plants must be eliminated.

Tree of heaven is fast growing, can reach 90 feet in height, and live 30 to 70 years. This species is highly adaptable and tolerant of disturbance. It is dioecious, meaning there are separate male and female plants. Female plants produce prolific amounts of seed, up to 325,000 seeds per year. Tree of heaven spreads aggressively in response to above-ground cutting or root breaking. Root fragments found in infested soil may start new populations.

Tree of heaven is the preferred host for the invasive spotted lanternfly (Lycorma delicatula). Spotted lanternfly can attack over 65 tree species, including trees grown in Minnesota. Spotted lanternfly was detected in Pennsylvania in 2014 and has spread to surrounding states over the last several years, but it has not been found in Minnesota.

Tree of heaven may play a particularly important role in the spotted lanternfly lifecycle.  To date, only two tree of heaven plants have been found in Minnesota, and both populations were eradicated. It is unknown if the absence of tree of heaven will affect the ability of spotted lanternfly to establish in this state. If you suspect that you have found a tree of heaven or spotted lanternfly:

  • Note the exact location with address or GPS coordinates.
  • If it is possible, take digital photos of the tree – whole plant, rosettes, flowers, and seed stalks – and suspected spotted lanternfly that can be emailed for identification.
  • Infestations can be reported to one of two places:
    1. The Minnesota Department of Agriculture (MDA) by email at arrest.the.pest@state.mn.us or voicemail 1-888-545-6684
    2. Directly to EDDMapS through the Great Lakes Early Detection Network app on a smartphone or tablet.

Farmer optimism hits an all-time low

Farmer optimism is in the dumper and there is no nice way to say it. COVID-19 and its economic impact, low commodity prices, trade wars, and weather have made life even more challenging. DTN found out that farmer optimism is at a record low. They’ve been doing a tri-annual survey of farmers for several years and this spring’s Agricultural Confidence Index hit an all-time low mark.

The baseline for their survey is 100. Everything below 100 is pessimistic, and any number above 100 is considered optimistic.

“We do our survey in the spring, just before planting,” said DTN Editor-In-Chief Greg Horstmeier. “We also do one at harvest, and then our final survey is in December, which is basically farm tax time. The drop in the index from the last time we did this in December is not a surprise, given everything that’s going on.

“It was a record-sized drop down to an index reading of 67,” he added. “That’s a 97-point drop, which is even more remarkable because we’re hearing that agriculture is moving on as normal. Everyone is either getting ready to or heading out into the field, so that big of a damper on the survey results is surprising.”

Horstmeier said spring is typically the most optimistic time of the year for farmers. New crops are going into the ground, which automatically means a fresh start, especially if the year before was as tough as 2019. Low optimism in the spring isn’t unusual. What’s unusual about this survey is how pessimistic farmers are about the future outlook.

The future outlook is typically very optimistic during the spring survey. “This year, that index reading was 73, which means it dove hard into negative territory,” Horstmeier said. “That was the big takeaway for me. Not only does the current situation have farmers in a pessimistic state of mind, but they don’t have a lot of promise for the foreseeable future.”

Another thing that really stood out was just how prevalent the pessimism is in different sectors of agriculture. It didn’t matter what farmers grew or how big their operations were, either. Even in down years, there’s typically difference worth noting.

“We typically see at least some differences between, for example, livestock and crop producers,” Horstmeier said. “We’ve also seen regional differences, such as the Midwest may be less optimistic than farmers in the Southeast. The pessimism was across the board, regardless of location, income level, the crops they grew, and what kind of enterprises they had.”

Speaking of Midwest farmers, in this year’s survey they showed the most pessimism currently, yet they also had the most optimism for the future. Southeastern farmers were more optimistic about their current conditions (89) but felt less optimism for their future (56).

DTN also conducts a similar survey of agribusinesses. The index level came in at a just-above-neutral 104. Agribusinesses rated their current conditions at a slightly pessimistic 85. However, they were above neutral when looking at the future, coming in at 118.

Water quality awards given out to two Minnesota farmers

Water quality is a hot topic of conversation in Minnesota right now, with the state’s farmers at the forefront of the discussion in award-winning fashion.

Two Minnesota farmers are being recognized for their commitment to agriculture, water quality, and wildlife. Randy Schmiesing of Stevens County, as well as Tom Cotter of Mower County, were recently given the new Minnesota Agricultural Water Quality Certification Program (MAWQCP) wildlife endorsement at the Pheasants Forever National Pheasant Fest in Minneapolis. Schmiesing and Cotter are the first farmers in the state to receive the endorsement.

“Conserving our natural resources for future generations to enjoy has been a lifelong goal and commitment,” said Randy Schmiesing. “We are proud to be one of the first farms to be certified by the Minnesota Department of Agriculture for the wildlife endorsement through the Minnesota Agricultural Water Quality Certification Program and encourage other farmers to pursue this wildlife endorsement and reap the many benefits it achieves.”

MAWQCP launched the wildlife, soil health, and integrated pest-management endorsements in December as additions to the 10-year certification a farmer or landowner receives in the program. The certification program partnered with various non-profit organizations like Pheasants Forever and the Minnesota Soil Health Coalition, as well as state agencies, to develop the endorsements.

“Many conservation practices targeting water quality also have benefits for other conservation goals, such as wildlife,” said Agriculture Commissioner Thom Petersen. “With the help of organizations like Pheasants Forever, we want to recognize farmers who are making efforts to protect our numerous natural resources in Minnesota.”

“Pheasants Forever appreciates the opportunity to work alongside the Minnesota Department of Agriculture and other partners in highlighting the new wildlife endorsement through the MAWQCP at Pheasant Fest,” said Tanner Bruse, Agriculture and Conservation Programs Manager, Pheasants Forever. “It’s our honor to be a part of the recognition of those implementing conservation practices that represent a win-win scenario for their operation, soil, water and wildlife. We congratulate them and thank them for their stewardship.”

Certified producers who achieve an endorsement will receive an additional sign for their farm and recognition for their conservation excellence.

About the Minnesota Agricultural Water Quality Certification Program

The Minnesota Agricultural Water Quality Certification Program is a voluntary opportunity for farmers and agricultural landowners to take the lead in implementing conservation practices that protect our water. Those who implement and maintain approved farm management practices will be certified and in turn obtain regulatory certainty for a period of ten years. The program is available to farmers and landowners statewide. To date, the program has certified 832 farms totaling 566,862 acres.

Japanese Hops Invading Southeast Minnesota

Japanese hops is and invasive weed that’s overtaking the banks of the Root River in southeastern Minnesota and growing onto adjacent property. Weed experts at the Minnesota Department of Agriculture (MDA) are asking for the public’s help in controlling the weed and reporting new finds.

Infestations are popping up along the Root River from Preston to the confluence of the Mississippi River. Small infestations of Japanese hops have also popped up in Winona; however, these have been controlled.

Japanese hops are annual vines native to eastern Asia that can grow up to 35 feet in a single growing season. With this explosive growth, the vines smother native vegetation and even grow into trees. Leaves are approximately 2-6 inches long and have at least 5 lobes that are shaped like a hand with the fingers extended. There are separate male and female plants that are beginning to flower this time of year. Seed production then follows.

Minnesota is also home to American hops. It is a native perennial vine that looks similar but often has 1-5 lobes and does not have more than 5 lobes on the leaves.

“We don’t know how they got to the Root River; but now that it’s here, we need to work together with the public to control this invasive weed,” said Christina Basch, Noxious Weed Specialist at the MDA. “Since Japanese hops is a prohibited noxious weed on the state’s eradicate list, it’s important that we find infestations and work to get rid of it.”

For successful Japanese hops control, the dispersal of mature seed must be stopped. This can be done by pulling or cutting the vines at the base or with herbicide treatment. Herbicide treatment is the only practical approach for large infestations that can’t be mowed. Experimental torching of seedlings appears to be effective for control of small infestations.

If you find Japanese hops on your land and the infestation is beyond what you can manage, report it to the MDA’s Arrest the Pest line at arrest.the.pest@state.mn.us or 1-888-545-6684. It is helpful to include photos with the report. It is also important to report infestations other than those on the Root River.

Work is already underway to control Japanese hops in the Root River area. Through a grant from the MDA, the Fillmore Soil Water Conservation District and Houston County Planning and Zoning are conducting hops treatments on the Root River banks. Fillmore and Houston County officials, with grants from the Board of Water and Soil Resources Clean Water Fund, are also using Conservation Corps Minnesota (CCM) to control hops along the Root River Trail. The MDA is working with landowners and CCM to control hops on private lands. The MDA’s work to control Japanese hops and oversee the coordinated efforts is supported by the Environment and Natural Resources Trust Fund as recommended by the Legislative-Citizens Commission on Minnesota Resources.

Prevent plant acres with cover crops can be utilized on Sept. 1

Cover Crops might be a really good idea for empty prevent plant acres in farm country. The U.S. Department of Agriculture just announced that farmers who planted cover crops on prevented plant acres will be permitted to hay, graze or chop those fields earlier than November this year. USDA’s Risk Management Agency (RMA) adjusted the 2019 final haying and grazing date from November 1 to September 1 to help farmers who couldn’t plant crops because of flooding and excess rainfall this spring.

“We recognize farmers were greatly impacted by some of the unprecedented flooding and excessive rain this spring, and we made this one-year adjustment to help farmers with the tough decisions they are facing this year,” said Under Secretary for Farm Production and Conservation Bill Northey. “This change will make good stewardship of the land easier to accomplish while also providing an opportunity to ensure quality forage is available for livestock this fall.”

RMA has also determined that silage, haylage and baleage should be treated in the same manner as haying and grazing for this year. Producers can hay, graze or cut cover crops for silage, haylage or baleage on prevented plant acres on or after September 1 and still maintain eligibility for their full 2019 prevented planting indemnity.

“These adjustments have been made for 2019 only,” said RMA Administrator Martin Barbre. “RMA will evaluate the prudence of a permanent adjustment moving forward.”

Other USDA Programs
Other USDA agencies are also assisting producers with delayed or prevented planting. USDA’s Farm Service Agency (FSA) is extending the deadline to report prevented plant acres in select counties, and USDA’s Natural Resources Conservation Service (NRCS) is holding special sign-ups for the Environmental Quality Incentives Program in certain states to help with planting cover crops on impacted lands. Minnesota’s Dicamba Cutoff is June 20

Dicamba is an important tool for farmers when it comes to controlling weeds. The Minnesota Department of Agriculture (MDA) wants to remind pesticide applicators of the state-specific dicamba cutoff for the 2019 growing season. Product application cannot take place in Minnesota after June 20.

The 2019 Minnesota dicamba cutoff is in addition to those established by the U.S. Environmental Protection Agency (EPA). The affected formulations are XtendiMax by Monsanto, Engenia by BASF, FeXapan by DuPont, and Tavium by Syngenta.

“We understand that late planting this season has caused concern for growers who want to use this crop management tool,” said Agriculture Commissioner Thom Petersen. “However, delaying applications in an attempt to control later emerging weeds can result in poor control and presents other risks. If you are one of the growers that has invested in dicamba technology, now is the time to use it for the dicamba cutoff date. The University of Minnesota Extension says late planting combined with pre-plant tillage can offer advantages for weed control.”

The June 20, 2019, the dicamba cutoff date is based on the MDA’s ongoing investigations and informal surveys into reports of crop damage from alleged dicamba off-target movement over the past two growing seasons. In 2017, the MDA received 253 reports of alleged dicamba drift; 55 of those were formal complaints requesting investigations. Those reports impacted an estimated 265,000 acres. After state restrictions were put in place for the 2018 growing season, the number of complaints dropped dramatically to 53 reports, of which 29 were formal complaints. Just over 1,800 acres were impacted in 2018.

This year’s dicamba cutoff date was first announced on December 10, 2018. Over the winter, approximately 5,800 pesticide applicators attended trainings across the state as required by the product labels.

Dicamba is most effective early in the growing season. Product labels recommend application on small broadleaf weeds that are up to 4 inches tall.

To manage weeds after June 20, growers can use herbicides from Group 9 (Glyphosate), Group 2 (Pursuit, Classic, FirstRate), and Group 14 (Flexstar, Cobra, Cadet, Ultra Blazer). If you have herbicide resistant weeds such as water hemp, follow University of Minnesota Extension recommendations on layering of residual herbicides such as Dual, Outlook, Warrant, and Valor.

In Minnesota, the XtendiMax, Engenia, FeXapan, and Tavium formulations of dicamba are “Restricted Use Pesticides” for retail sale to, and for use only by, certified applicators.

MDA Issues Advisory on Cover Crop Seed

Minnesota Seed Law must be followed on prevented planting acres

Minnesota farmers may be in the market for more cover crop seed than in previous years. Poor planting conditions this spring are forcing some farmers to make decisions on prevented planting. The Minnesota Department of Agriculture (MDA) wants to remind farmers about the legal requirements for selling and buying seed in Minnesota, which does include cover crop seed.

MDA says it has seen several issues in past years that violate Minnesota’s Seed Law. Buying grain from an elevator for the purpose of sowing is not legal. It is also illegal to brown bag or sell grain out of a bin. Furthermore, all seed sold in the state must be labeled.

“Minnesota’s Seed Law restricts these activities for numerous reasons, ” said Denise Thiede, MDA’s Seed Unit Supervisor. “Farmers could be bringing in weeds through unlabeled and untested seed, or they may not be get the type or quality of seed they paid for.”

In addition, almost all seed varieties have some form of intellectual property protection that restricts the use and sale of the variety under the federal Plant Variety Protection Act. Violating this act can lead to significant fines for both the seller and the buyer.

If farmers are buying seed to sow on their land, the MDA offers the following advice:

  1. Make sure the seed has a label.
  2. Confirm the cover crop seed has been tested for noxious weed seeds, including Palmer amaranth.
  3. Make sure that it is a legal sale by asking the seller if they have the legal authority to sell the product.
  4. Ask about the variety of seed. A variety protected by the Plant Variety Protection Act must be sold by variety name and may be required to be sold as a class of certified seed.

Japanese Hops are MDA Weed of the Month

When you hear the word “hops,” you might think of beer. Hops are used in beer production to add bitter, floral, fruity, or citric flavors and essential oils for preservation. However, Japanese hops lack an essential resin for beer production. Common hops are a similar native species and can be used for beer production. Introduced to North America as ornamental vines, they are native to eastern Asia. Unfortunately, Japanese hops escaped cultivation and have become invasive.

Japanese hops have distinct bracts where the leaf and petiole attach to the stem. The leaves have toothed edges with 5 to 9 lobes arranged palmately (shaped like a hand with fingers extended), while common hops only have up to 5 lobes.

The weed has both male and female vines. With female vines, seeds are produced in conical husks; male vines produce pollen from flowers. Hooked hairs on the stem and leaves help the vines climb but can irritate human skin after contact.

Seeds from the vine are easily dispersed by wind, water, wildlife, vehicles, and equipment. This allows the invasive weed to grow very rapidly. In just one season, they can grow up to 35 feet long. The vines twine around to climb vegetation and structures, capable of smothering desirable vegetation and producing dense mats several feet thick.

Japanese hops are annual vines in Minnesota but can be perennial in warmer climates. They thrive in partial to full sun including next to rivers, along roadsides, grasslands, and forest edges.

They’ve been found in southeastern Minnesota along the Root and Mississippi rivers, as well as in the city of Winona. Most infestations are on riverbanks and creep into adjacent forest understory.
